QUEENSLAND POOL SAFETY LAWS
There is some confusion within the community about the requirement about when small inflated and rigid swimming pools require a building approval and safety fencing installed.
From 1 December 2015 all swimming pools within Queensland were required to comply with current laws for safety fencing.
There have been a number of different standards for fencing that applied to swimming pools over the previous years and all pools MUST now comply with the latest fencing requirements.
Small inflatable pools and rigid wall pools that are 0.3m in depth or capable of being filled with 300mm or more of water, require building approval and must be fenced under the Queensland State Law.
All swimming pools that require building approval within Queensland MUST be registered with the QBCC and Council.
Council Pool Safety Inspectors will not be undertaking routine inspections of all swimming pools within the Council area; it is the property owner’s responsibility to ensure their pool complies. If in doubt Council can provide a compliance check however this is a fee for service charge.
Properties that are rented and have pools installed must have a current Pool Safety Certificate.
Where swimming pools are detected in house yards the owner and occupier will be issued with a letter requiring the pool to be fenced and a building approval applied for.

As part of these newly introduced pool safety laws, residents are required to have their swimming pool registered. The relevant application form is to be completed and submitted to Council, together with an inspection fee (please refer to Council's Fees & Charges for current fee).
