Reconfiguring a lot
Any changes to the boundaries of land are called "reconfiguring a lot". This generally includes:
- subdiving a lot;
- amalgamating 2 or more lots
- rearranging the boundaries of a lot;
- dividing land into separate parts by agreement, including a lease for a term, including renewal options, exceeding 10 years;
- creating an easement giving access to a lot from a constructed road.
What is subdivision
Under the Planning Act 2016, all subdivision is called "reconfiguring a lot".
Most subdivisions need planning approval from Goondiwindi Regional Council. You need to apply for approval for reconfiguring a lot to subdivide land.
Proposed subdivisions are assessed according to the relevant planning scheme to ensure that lots:
- have an appropriate size and shape for a home or other use
- have minimal impacts on surrounding land uses
You will need to use a land surveyor and possibly other specialists to subdivide land. If the reconfiguring a lot application is approved, you will need to have the plan of survey approved by the Council. You must then arrange for the plans to go to the Queensland Titles Office within the Department Natural Resources and Mines to be registered. After the survey plan is registered, separate titles are then created for each lot.
There will be costs to connect any new lots to Council infrastructure such as water and sewerage. In addition to the connection costs, you may be required to pay a contribution towards other Council services such as parks and gardens.
